Macau’s Court of Second Instance has denied an appeal by Galaxy Entertainment for an action against Wynn Resorts regarding the trademarking of its ‘SW’ logo, local media reports.
The case first came to light in 2013 when Wynn registered a trademark for the use of the ‘SW’ logo in drinks and food.
Galaxy contested the trademark on the grounds that the consumer may confuse the ‘SW’ to mean Galaxy’s StarWorld Macau Casino.
The argument was rejected by the Judiciary Council of Macau, which was then appealed by the casino operator.
According to a court statement, although the brand comprises of only two letters, they are distinct enough that the average consumer should not confuse the two.
